Terms and Conditions of Trade

These terms apply to all sale of goods contracts. Placing an order with Easy Office Supplies constitutes your agreement to be bound by these terms. Any additional or different terms you stipulate are objected to unless agreed in writing. Receipt of goods upon delivery also constitutes acceptance of these terms.

1. Sale and Purchase

a. Your placement of an order constitutes an offer to purchase goods on these terms. Orders are placed when submitted by email or telephone.

b. If we accept the order, a binding contract between you and us will arise on these terms.

2. Payment Terms

a. The customer must pay for any goods or services on or before the due date.

b. In the event of non-payment, the customer is liable for all reasonable expenses incurred by Easy Office Supplies, including legal fees, service of notices, and any court procedures required to recover monies owed.

3. Delivery

a. We will deliver to the address stated in the order or as agreed in writing. EOS reserves the right to charge for delivery at any time.

b. We are not responsible for part delivery or delay, nor for any consequences (direct or indirect) arising from such delay or non-delivery.

c. We reserve the right to charge for and recover any costs arising from your failure to collect or take delivery of goods.

d. You must notify EOS in writing within 30 days of the invoice date if proof of delivery is required. No liability lies with EOS after this period.

e. Online delivery rates apply only to orders processed through easyofficesupplies.com.au. Phone and email orders are charged at normal rates. Extra charges may apply for promotional items requiring registered express shipping.

4. Returns

a. Goods come with guarantees under the Australian Consumer Law.

b. Inspect goods upon receipt. If goods do not satisfy your order, notify EOS immediately by phone.

c. Goods must not be returned without authorisation. When authorised, you will receive a Returns Authorisation Number (RAN) referencing the specific goods in question.

d. Returns are accepted only if goods are unmarked, undamaged, and in resalable condition. A 25% restocking fee may apply for change-of-mind returns. Returns can only be made within 10 days of receipt unless goods are faulty.

e. The RAN must appear on the outside of the package. Goods returned by unauthorised methods will incur additional freight charges at the customer’s expense.

f. Faulty cartridges must be at least 75% full to be accepted for return. Refilled or tampered cartridges will not be credited.

⚠ From March 2020, change-of-mind refunds on essential items (toilet paper, hand sanitiser, hand towels, soap, facial tissues) have been temporarily suspended to discourage over-purchasing.

5. Title and Risk

a. Risk passes to you at the time of delivery in accordance with Condition 3.

b. Title and property in the goods remain with EOS until payment in full has been received.

c. Pending full payment, you must retain goods on your premises clearly identified as EOS property, and must not deal with, dispose of, or part with possession of the goods.

d. In the event of payment default, EOS and its agents have the right to enter premises to repossess the goods, and may resell to a third party without liability to you.

e. If you sell goods to a third party before paying in full, EOS is entitled to the portion of sale proceeds equivalent to the outstanding amount.

f. EOS may charge for and recover all costs incurred in exercising its rights, including storage, transportation, and administration costs.

6. Authorisation and Disclosure

a. By purchasing, you agree to receive updates on monthly promotions and special deals. Please advise us if you do not wish to receive such material.

b. EOS may collect and use your information for the purpose of assessing your creditworthiness.

7. Limitation of Liability

Where goods or services are not of a kind ordinarily acquired for personal, domestic, or household consumption, our liability for failure to comply with a guarantee under the Australian Consumer Law is limited to repair or replacement of the goods, or supply of equivalent goods, to the extent permitted by law.

8. Governing Law

This contract is governed by the laws of the State of Victoria and the Commonwealth of Australia.

9. Notice

All notices must be in writing and may be given in person, by fax, or by email. Any changes to notice details must also be communicated in writing.

10. Variations

EOS reserves the right to amend these Terms and Conditions at any time.
